These Terms and Conditions apply to the site www.eduardmihaila.com owned by HOT BRANDS DESIGN S.R.L.

HBD reserves the right to make changes to the content of this site, as well as to these Terms and Conditions, without any prior notice to Users. In case of divergence or misunderstandings between the Company and the User, the Terms and Conditions valid at the time of using the www.eduardmihaila.com will apply.

d. HBD data or other privileged data of the Company. User – the natural person who navigates the Site or interacts, in various forms, with it and has access to the Content;

Personal data - any information regarding an identified or identifiable natural person ("data subject"). It represents personal data (non-exhaustive enumeration): name and surname of the person, e-mail address, telephone number, etc.;

Personal data controller – means the natural or legal person, public authority, agency or other body which, alone or together with others, establishes the purposes and means of the processing of personal data. Regarding the Site, the data controller is represented by HBD;

The document establishes the terms and conditions of use of the Site/Content by the User. The User is asked to read this document carefully in order to prevent any unwanted/unpleasant consequences, which may be appreciated by him as having a negative impact on his data and/or the information provided HBD company.

The site contains information, presentations and articles regarding the range of evaluation services offered by HBD, but also related to other related fields of interest. To request an offer, the User will access the "SEND BRIEF", "GET IN TOUCH" or other form section available on the website, in the sections related to the evaluation services offered by HBD.

In the form, the User will have to fill in the fields related to the name, phone number and message, and will be contacted by an HBD representative in due time, respectively within 1-5 working days.

The user can schedule an appointment by filling out the form available in the specific section, and will be contacted by an HBD representative to confirm the appointment.

In case of redirection to a third-party website, these Terms and Conditions will no longer be applicable when the User navigates on that website. Thus, from the moment of redirecting the User, HBD does not assume responsibility in any situation regarding the policies, terms and conditions applicable on the respective online platform. By using the Site, the User is solely responsible for all activities arising from its use. Also, he is responsible for any material, intellectual, electronic or any other damage caused to the Site and/or the Content made available by HBD, in accordance with the national legislation in force.

If the User does not agree with these Terms and Conditions and/or does not accept this Document, he has the possibility to send an e-mail to the electronic correspondence address: eduard.mihaila@icloud.com and specify the reasons and/or requests to operate the desired changes. The user can revert at any time on his decision not to agree and/or not to accept the Document.

The name of the Website and its graphic signs are the property of HBD or, as the case may be, the Company has a right of use over them, so these elements cannot be taken over, copied or used without the written consent of their owner/holder.
The entire Content presented or displayed within the Site including, but not limited to: text, graphics, photos, images, moving images, sound and illustrations, etc. is the property of HBD. All elements are protected by copyright, author's rights and other regulations on intellectual property rights.

HBD declares on its own responsibility that all the content on the website www.eduardmihaila.com is original and that it uses resources, if necessary, (product images, video, text, specifications, etc.) with the consent of the source, without violating the Law no. 8/1996 regarding copyright and related rights. Reporting cases of copyright infringement will be done in writing to the e-mail address eduard.mihaila@icloud.com.
The User may not modify any of the aforementioned materials and may not copy, distribute, transmit, display, perform, reproduce, publish, license, create works derived from them, transfer or sell information or works contained on the www.eduardmihaila.com.

With the exception of the actions permitted by the applicable legislation and this document, the User is responsible for obtaining permission before using any material protected by copyright or other intellectual property rights that is made available by HBD .
Any Content to which the User has and/or obtains access by any means is subject to the Document if the Content is not accompanied by a specific and valid user agreement concluded between HBD and the User and without any implied or express guarantee from the HBD with respect to that Content.

The communication of any information or data in the form of a message, text, image, audio and/or video file or any other type of material, regardless of the method of publishing or transmitting them (public or individual), by any natural or legal person, other than HBD, is carried out on the sole responsibility of the person to whom these materials belong, the Company not being in any way responsible for the content or the method of publication of these communications.
HBD gives the User the right to use, in the form described in a separate user agreement, a certain Content to which the User has or obtains access following this agreement, this right extends only to that or those Content defined in agreement, only during the existence of it or these Contents on the Site or the period defined in the agreement, according to the conditions defined therein, if they exist and do not represent a contractual commitment on the part of HBD for the respective User or any other third party who has/ obtain access to this transferred content, by any means and that could be or is harmed in any way by this Content, during or after the expiration of the user agreement.

No Content transmitted to the User, by any means of communication (electronic, telephone, etc.) or acquired by him by accessing, visiting and/or viewing does not constitute a contractual obligation on the part of HBD and/or the employee of the Company, who mediated the transfer of Content, if it exists.
Any use of the Content for purposes other than those expressly permitted by the Document/ provided in a separate usage agreement, if it exists/ by the applicable legislation in the matter is prohibited.

The user is responsible for any intellectual damage caused to the Site, the Content or any third party/partner/collaborator with whom HBD has concluded contracts, in accordance with the Romanian legislation in force.

HBD makes every effort to ensure that it protects and respects the confidentiality of personal data belonging to its Users, by implementing appropriate technical and organizational measures, in accordance with the requirements of Regulation no. 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free circulation of such data and on the repeal of Directive 95/46/CE (General Data Protection Regulation) and Law no. 190/2018 regarding the implementation of the General Regulation on Data Protection and good practices in data processing.

The information provided by the User will be stored by HBD in electronic format and will not be provided to any other third party, except those directly involved in providing the specific services of the www.eduardmihaila.com website.

HBD reserves the right not to respond to all requests of any nature, especially if they are unfounded/abusive, received by any means of communication (electronic, telephone, etc.).

The user expressly declares that the contact data provided by sending them to the e-mail address eduard.mihaila@icloud.com belong to him (for example: first and last name, e-mail address, telephone number, etc.) and that these data will be able be used by the Company in its communications with the User, in order to resolve any requests, but also to provide additional information, at the User's request.

Receiving Newsletters and other alerts of this kind requires ticking the corresponding box in the form on the Site, commercial and informative communications being sent only based on the express consent of the Client. Thus, the User becomes a Subscriber and unconditionally accepts including the present Terms and Conditions if he has not previously expressed his agreement regarding the receipt of such communications through another method.

The subscription to the Newsletter offered by HBD can only be carried out if the User is 18 years old at the time of submitting the subscription intention or has the consent of the legal representative in this regard and is not conditioned by the payment of a fee or the registration of a user account.

The personal data used by HBD for the transmission of newsletters will be used by the Provider only for the purposes described in the Privacy Policy, and in accordance with its provisions, a document available for consultation on the Site.

Renunciation of receiving the Newsletter by the Subscriber can be done at any time, easily, by withdrawing the consent regarding the processing of his data for marketing purposes and by expressing the intention to unsubscribe, as follows:
a. using the specific unsubscribe option from any newsletter received;
b. by contacting the Provider via e-mail and sending the intention to unsubscribe from the Newsletter and without any subsequent mutual obligation of any Party or without any Party being able to claim damages from the other.

HBD does not request from its Users by any means of communication (e-mail/telephone/SMS) information regarding confidential data, accounts or personal passwords. The user assumes full responsibility for the disclosure of a third party of his confidential data.

The Provider disclaims any liability in the event that a User would be / is prejudiced in any form by a third party who would claim to be / represent the interests of the Provider. The User shall inform the Provider of such attempts, using the contact details.

HBD does not promote SPAM.

Any User who has explicitly provided his/her e-mail address on the Site may choose to delete it.

The communications made by HBD by electronic means of remote communication (i.e. e.mail) contain the complete and compliant identification data of the sender or links to them, at the date of transmission of the Content.

The following purposes achieved or not shall be considered an attempt to defraud the Site/Content and/or the Provider and, in this case, the criminal investigation will be initiated against the one or those who attempted to or achieved this purpose(s):
• to access the data of any type of another User by using the HBD member account or by any other method;
• to alter or otherwise modify the content of the Site or the Content sent by any method by the Provider to the User;
• to affect the performance of the server /servers on which the Site runs;

The user is solely responsible for the correctness of the information entered in the forms on the site.

HBD is not responsible for errors or omissions that may occur in the drafting or presentation of materials on the site, which are not considered essential information according to the law.

HBD does not guarantee the User access to the Site or to the Service.

HBD is not responsible for the content, quality or nature of other sites reached through links in the Content, regardless of the nature of such links. For those sites, the responsibility lies entirely with their owners.

The Provider is exonerated of any fault in case of using the Site and / or the Content transmitted to the User or Client by any means (electronically, by phone, etc.), through the Site, e-mail or an employee of HBD, when this use of the Content may effectively cause damage of any kind on the part of the User, Client and / or any third party involved in this transfer of Content.

HBD cannot be held liable in any way to any Client who uses the Site or the Content, other than within the limits of the articles constituting the Terms and Conditions.

The Provider assumes no responsibility for potential malware that could infect your computer or other goods after accessing or using this Site or downloading any material, information, text, video or audio images from it.

The Provider is not liable for covering the claims of third parties, of any kind, that may result in relation to the use, copying or falsification of the Site or its content or of any other related Site, by third parties, unauthorized by HBD , regardless of whether it was informed, knew or should have known this possibility.

HBD does not offer any direct or indirect warranties of any kind as:

• The Service will be uninterrupted, secure or error-free of any kind;
• The Services will meet the subjective requirements or expectations of the User.
